Protecting Rights, Promoting Respect: RA 8353 & RA 7877



  The fight against sexual harassment and violence is very important, for it is in the enhancement of human dignity and the rearing of a safe community. In the Philippines, it has been enacted two particular laws: the Anti-Rape Law of 1997 (RA 8353) and the Anti-Sexual Harassment Act of 1995 (RA 7877). These laws prevent sexual crimes, protect victim rights, and punish malefactors. This article will discuss their importance as well as their provisions- how they impact the protection of rights.


   RA 8353: The Anti-Rape Law of 1997

RA 8353 redefined rape as a crime against persons instead of chastity, focusing on the issue of human dignity violation. It expanded the definition of rape to include acts other than sexual penetration, such as object or instrument insertion, and considered both men and women as potential victims. Cases that are perpetrated through force, threat, or incapacitation by which the victim is incapable of giving consent due to his being unconscious or under the influence of any substance were included. RA 8353 strengthens the framework for addressing sexual violence and ensuring justice to its survivors by expanding legal definition of rape.

 

  RA 7877: Anti-Sexual Harassment Act of 1995

RA 7877 is the law that focuses on preventing and addressing sexual harassment in work, educational, and training environments. This law defines sexual harassment as any unwelcome sexual advance, request for sexual favors, or verbal or physical conduct of a sexual nature when it affects an individual's work performance, creates a hostile environment, or is used as a basis for employment or academic decisions. RA 7877 holds employers, managers, and heads of institutions liable for creating a harassment-free environment through policies and complaint mechanisms. This law empowers the victims to seek redress while fostering safer spaces for the employees and students. 


  RA 8353 and RA 7877 are two important legal documents in the Philippines' struggle against sexual violence and harassment. While one addresses the serious crime of rape, the other talks about creating a respectful, safe environment free from harassment. Together, these laws promote justice while protecting victims and emphasizing respect and dignity in all circumstances. Continued education and awareness are therefore vital in implementing these laws effectively to create a society where people can feel safe and valued.
